Terms of Service

These Terms of Service ("Terms") govern your use of the Stance Finance website and application (the "Service"). Please read them carefully. By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Who we are

The Service is operated by Brian Bashala, trading as Stance Finance, a sole proprietor based in South Africa ("Stance", "we", "us", or "our"). You can reach us at support@stancefinance.co.za.

2. What Stance is — and what it is not

Stance is an educational tax-information tool for South African taxpayers. It provides calculators, estimates, explanations, a tax health score, document analysis, and an AI advisor to help you understand your tax position.

Stance is not a registered tax practitioner, financial-services provider, accountant, or law firm. Nothing in the Service is tax, financial, accounting, or legal advice, and using it does not create a professional or advisory relationship. The Service is a guide to help you understand and prepare — it does not file returns with SARS on your behalf, and it is not a substitute for advice from a registered tax practitioner. You remain solely responsible for your own tax affairs, returns, and decisions.

3. Eligibility

You must be at least 18 years old and capable of entering into a binding agreement to use the Service. By using the Service, you confirm that you meet these requirements.

4. Your account

You are responsible for keeping your login details secure and for all activity under your account. Please give accurate information and keep it up to date. Tell us promptly at support@stancefinance.co.za if you believe your account has been compromised.

5. Acceptable use

You agree to use the Service only for lawful, personal purposes, and not to:

  • misuse, overload, disrupt, or attempt to gain unauthorised access to the Service or its systems;
  • copy, scrape, resell, sublicense, or commercially exploit the Service or its content without our written permission;
  • exceed or attempt to circumvent fair-use limits, or use automated means to access the Service;
  • upload unlawful content, malware, or personal information of other people that you have no right to share; or
  • rely on the Service in a way that is unreasonable given that its outputs are estimates and may contain errors.

We may apply reasonable fair-use limits to protect the Service and may suspend access where these Terms are breached.

6. AI-generated content and accuracy

Parts of the Service use artificial intelligence to generate responses, estimates, and document summaries. These outputs are educational estimates and explanations, generated automatically, and may be incomplete or incorrect. Tax figures are based on published SARS rates and the information you provide; your actual position depends on the full detail of your circumstances and your SARS assessment.

You should independently verify anything material, and consult a registered tax practitioner before making decisions or filing a return. You are responsible for any decisions you make based on the Service, and for the accuracy and completeness of the information you submit to SARS.

7. Subscriptions, billing, and cancellation

The Service offers a free tier with daily usage limits and a paid subscription ("Professional Plus") that unlocks additional features. Current features and prices are shown on our pricing page and at sign-up.

If you subscribe:

  • payments are processed by our payment provider (PayFast). We do not store your full card details;
  • subscriptions are billed in advance on a recurring basis (for example monthly or annually) and renew automatically until cancelled;
  • you may cancel at any time, and cancellation stops future renewals; and
  • refunds and cancellations are governed by our Refund and Cancellation Policy, which forms part of these Terms.

We may change our prices or plans. Where changes affect an active subscription, we will give you reasonable notice, and any change will apply from your next billing cycle.

8. Your content and documents

You keep ownership of the information and documents you upload (your "Content"). You grant us a limited, non-exclusive licence to store and process your Content only as needed to provide the Service to you — for example, to analyse a document you submit or to save your tax profile. We handle your Content as described in our Privacy Policy. You are responsible for your Content and confirm you have the right to upload it.

9. Our intellectual property

The Service, including its design, software, text, and branding, is owned by us or our licensors and is protected by law. These Terms do not transfer any of our intellectual-property rights to you. You may use the Service only as permitted here.

10. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that its outputs are accurate, complete, or suitable for your particular circumstances. Any reliance you place on the Service is at your own risk, subject to your rights under applicable law.

11. Limitation of liability

To the fullest extent permitted by law, and subject to your rights under the Consumer Protection Act and other applicable South African law, we will not be liable for any indirect, incidental, or consequential loss, or for any loss arising from your reliance on the Service's outputs, including any tax, penalty, interest, or assessment outcome. Where we are found liable despite this, our total liability to you is limited to the amount you paid us for the Service in the three months before the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded by law.

12. Indemnity

You agree to indemnify us against reasonable claims, losses, and costs arising from your misuse of the Service or your breach of these Terms, to the extent permitted by law.

13. Suspension and termination

You may stop using the Service at any time and can delete your account from the Security and data settings. We may suspend or terminate access if you breach these Terms or use the Service unlawfully. On termination, your right to use the Service ends, and your data is handled as set out in our Privacy Policy.

14. Changes to the Service and these Terms

We may update or change the Service, and we may update these Terms from time to time. When we make material changes to the Terms, we will update the date above and, where appropriate, notify you. Your continued use of the Service after a change means you accept the updated Terms.

15. Governing law

These Terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction over any dispute, subject to any rights you have under applicable consumer-protection law.

16. General

If any part of these Terms is found unenforceable, the rest will remain in effect. These Terms, together with our Privacy Policy and Refund and Cancellation Policy, are the entire agreement between you and us regarding the Service.
